These Terms of Service ("Terms") govern your access to and use of the website located at phantomstudiolabs.com and all related tools, software, and services (collectively, the "Service") operated by Manaansh Srivastava, a sole proprietor based in Delhi, India, trading as "Phantom Studio Labs" ("we", "us", "our", or the "Company").
By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, you must not access or use the Service.
1. The Service — what it is and is not
Phantom Studio Labs is a self-service, automated platform that lets users generate short-form videos and related media using artificial intelligence ("AI"), based on inputs (such as topics, scripts, and settings) that the user supplies or selects. The Service is a neutral tool. It generates outputs automatically and on demand in response to user instructions.
- We do not create, commission, direct, endorse, review, or pre-screen the content that users generate, request, publish, or distribute.
- We do not control how, where, or for what purpose you use any output.
- AI output is generated by automated statistical models and may be inaccurate, incomplete, offensive, biased, or may unintentionally resemble existing works or real persons. You are responsible for reviewing, verifying, and deciding whether and how to use any output.
- The Service is provided for lawful purposes only.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) and legally able to enter into a binding contract.
- You must not be located in, or a resident of, any country or region subject to comprehensive sanctions, and you must not be a person with whom dealings are prohibited under applicable export-control, sanctions, or anti-terrorism laws.
- You must not have been previously suspended or removed from the Service.
- If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
3. Accounts and security
- You are responsible for all activity that occurs under your account, whether or not authorized by you.
- You must keep your login credentials confidential and notify us immediately of any unauthorized access.
- You must provide accurate information and not impersonate any person or entity or misrepresent your identity or affiliation.
- One person or entity may not maintain multiple accounts to abuse free credits, evade limits, or circumvent a suspension.
4. Credits, billing, payments, and funds
- The Service operates on a prepaid "credits" system. Credits are a limited, revocable licence to use the Service's features and have no monetary value, are not money, e-money, securities, or a deposit, are non-transferable, and cannot be redeemed, exchanged, or withdrawn for cash.
- Payments are processed by independent third-party payment processors who act as merchant of record and/or payment service provider. Your payment is also subject to their terms. We do not store full card or banking details.
- You agree to pay all applicable fees and taxes (including GST or other indirect taxes, where applicable).
- You represent and warrant that any payment method you use is lawfully yours (or that you are duly authorized to use it) and that all funds used are legitimately obtained from lawful sources.
- Refunds are governed by our Refund Policy.
- Initiating a chargeback, payment dispute, or reversal in bad faith (for example, after using credits) is a material breach of these Terms and may result in immediate suspension and recovery action.
5. Anti–money laundering, illicit funds, and financial crime
You must not use the Service, your account, credits, or any payment in connection with money laundering, terrorist financing, sanctions evasion, tax evasion, fraud, or any other financial crime. Without limitation, you must not:
- use proceeds of crime, unaccounted-for, undisclosed, or unlawfully obtained money ("black money"), or any funds derived from illegal activity, to purchase credits or pay for the Service;
- use stolen, cloned, unauthorized, or fraudulently obtained payment instruments, identities, or accounts;
- structure, layer, or route transactions to disguise the origin, ownership, or destination of funds, or to evade reporting thresholds, taxes, or currency controls;
- use the Service as a conduit to transfer, convert, or "clean" value, or to facilitate any such activity for a third party;
- transact while subject to sanctions or on behalf of any sanctioned or prohibited person or jurisdiction.
You acknowledge that credits are non-refundable to cash and non-transferable specifically so that the Service cannot be used as a value-transfer mechanism. We may refuse, hold, cancel, or reverse any transaction; require identity or source-of-funds verification; suspend or terminate accounts; and report suspicious activity, transactions, or accounts to our payment processors, financial institutions, and the appropriate authorities, in each case at our sole discretion and without liability to you. Responsibility for the legality of your funds and payments rests entirely with you.
6. Acceptable Use Policy — prohibited uses
You are solely and entirely responsible for the inputs you provide, the content you generate, and everything you do with that content. You agree that you will not, and will not permit, enable, or encourage any third party to, use the Service to create, request, upload, generate, store, publish, distribute, or facilitate any of the following. This list is illustrative and not exhaustive.
(a) Illegal activity
- Anything that violates any applicable local, national, or international law, regulation, sanction, or third-party right.
- Planning, promoting, facilitating, or instructing on any crime, act of violence, terrorism, trafficking, or other unlawful act.
- Sale or promotion of illegal goods or services, weapons, drugs, or other regulated or contraband items.
(b) Child safety (zero tolerance)
- Any content that sexualizes, exploits, endangers, or abuses minors, including child sexual abuse material (CSAM), or any content that sexualizes a person who appears to be a minor. Such activity will be reported to law enforcement and relevant authorities and will result in immediate, permanent termination.
(c) Impersonation, likeness, voice, and deepfakes
- Creating or distributing content that impersonates, depicts, or replicates the face, voice, name, signature, or likeness of any real person (living or dead), public figure, brand, or organization without all necessary rights, consents, and permissions.
- "Deepfakes," synthetic media, or manipulated content presented as real, or used to deceive, defraud, defame, harass, or mislead.
- Non-consensual intimate, sexual, or compromising depictions of any person.
(d) Intellectual-property infringement
- Infringing or misappropriating any copyright, trademark, trade secret, patent, publicity, or other proprietary right.
- Reproducing, scraping, "clipping," or repackaging third-party videos, music, scripts, characters, logos, or other protected works that you do not own or have no licence to use.
- Using the Service to compete with, replicate, or build a similar or substitute service.
(e) Deception, fraud, and harmful information
- Fraud, scams, phishing, fake reviews or endorsements, pyramid or Ponzi schemes, deceptive advertising, or "get-rich-quick" schemes.
- Disinformation, misinformation, manipulated media, or content intended to interfere with elections, public health, or civic processes.
- Content presented as professional medical, legal, financial, or safety advice without appropriate qualification and disclaimers.
(f) Hate, harassment, and violence
- Hate speech or content that demeans, harasses, threatens, bullies, or incites violence or discrimination against any individual or group (including on the basis of race, religion, caste, ethnicity, nationality, gender, sexual orientation, disability, or similar).
- Content that promotes, glorifies, or instructs self-harm, suicide, eating disorders, or violence.
- Graphic, gratuitous, or extreme violence or gore.
(g) Adult and sexual content
- Pornographic or sexually explicit content; sexual content involving real, identifiable persons without consent; or sexual content of any kind involving minors (which is strictly prohibited under section (b)).
(h) Privacy and security
- Doxxing, surveillance, stalking, or publishing private or personal information about others without consent.
- Malware, viruses, exploits, or any attempt to disrupt, overload, probe, scan, reverse-engineer, decompile, or gain unauthorized access to the Service, its infrastructure, or its providers.
- Circumventing usage limits, rate limits, watermarks, credit systems, security measures, or access controls.
- Automated access, scraping, or bulk extraction except as we expressly permit.
(i) Spam and platform abuse
- Spam, bulk unsolicited messaging, or mass low-quality content intended to manipulate any platform's systems.
- Use of outputs in any way that violates the terms or policies of the platform where they are published (for example, YouTube, TikTok, Instagram, or others). Compliance with destination-platform rules is your responsibility.
You assume all risk and responsibility for any prohibited use, whether by you or by anyone using your account. We have no obligation to monitor content but may, at our discretion, investigate, remove or disable content, and suspend or terminate accounts.
7. Your inputs and generated output
- Inputs. You retain ownership of the inputs you provide and represent that you have all rights necessary to provide them and to authorize their processing. You grant us a limited, worldwide, royalty-free licence to host, process, and transmit your inputs and outputs solely to operate, secure, and improve the Service.
- Output. Subject to your compliance with these Terms and payment of applicable fees, you may use the videos and media you generate ("Output"), including for commercial purposes. We make no representation or warranty that Output is original, unique, non-infringing, accurate, fit for any purpose, or free of third-party rights, and similar Output may be generated for other users. You are solely responsible for evaluating and using Output and for ensuring its lawfulness in your context.
- You are responsible for keeping your own copies of Output. We may delete stored files at any time.
8. Third-party services
The Service relies on third-party providers (including, without limitation, AI model, hosting, storage, voice, and payment providers). Your use may be subject to their terms, and we are not responsible for their acts, omissions, availability, or policies. Links to third-party sites are provided for convenience only.
9. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT OUTPUT WILL MEET YOUR EXPECTATIONS OR BE LAWFUL FOR YOUR INTENDED USE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR SUPPLIERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY. WE ARE NOT LIABLE FOR ANY CONTENT YOU OR ANY THIRD PARTY CREATES, PUBLISHES, OR DISTRIBUTES, OR FOR ANY CONSEQUENCES OF SUCH USE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) INR 5,000. Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its proprietor, affiliates, and suppliers from and against any and all claims, demands, investigations, liabilities, damages, losses, fines, penalties, and expenses (including reasonable legal fees) arising out of or relating to: (a) your inputs, Output, or use of the Service; (b) your violation of these Terms or any law or third-party right; (c) your content or conduct; or (d) any misuse of the Service through your account. We reserve the right to assume the exclusive defense of any matter subject to indemnification, at your expense, and you agree to cooperate.
12. Suspension and termination
- We may suspend, restrict, or terminate your access at any time, with or without notice, including for any actual or suspected breach of these Terms, suspected illegal or fraudulent activity, or to comply with law or a request from authorities.
- On termination, your right to use the Service ceases. Unused credits associated with an account terminated for breach may be forfeited and are non-refundable.
- Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Reporting, takedown, and grievance redressal
If you believe content generated or distributed via the Service infringes your rights or is unlawful, or if you have a grievance, contact our Grievance Officer with sufficient detail (including the content, the rights affected, and your contact information):
We will acknowledge complaints and act on valid notices of unlawful content within the timelines required by applicable law. We comply with applicable intermediary obligations and reserve the right to remove content and disable accounts as required.
14. Compliance with laws
You are solely responsible for complying with all laws applicable to your use of the Service and your Output, including intellectual-property, privacy, data-protection, advertising, consumer-protection, export-control, sanctions, and tax laws. You will not use the Service in violation of any such law.
15. Changes
We may modify the Service or these Terms at any time. Material changes will be indicated by updating the "Last updated" date and, where appropriate, by notice. Your continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.
16. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to applicable law, the courts at Delhi, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to such jurisdiction and venue. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be limited to the minimum extent necessary.
- No waiver. Our failure to enforce any provision is not a waiver.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- No agency. No partnership, agency, or employment relationship is created by these Terms.
